A revocable inter vivos trust created by a husband is property subject to the surviving wife's statutory share, the Iowa Supreme Court has ruled.
The husband created the trust and transferred farmland, all of his personal effects, vehicles and tools into it. He married a few years later. After his death, his wife elected not to take under his will, and sought to include the assets of the trust as property subject to her statutory share under Iowa state law.

provides guidance regarding whether the corpus of an inter vivos trust is includible in the grantor's gross estate under Section 2036 or 2038 if the grantor retained the power, exercisable in a nonfiduciary capacity, to acquire property held in the trust by substituting other property of equivalent value.
