  • Juries making capital punishment decisions must properly understand legal instructions if they are to perform their duties properly. The U.S. Supreme Court incorrectly insists on juror infallibility in the face of contradicting evidence that jurors often do not understand these instructions, for example not knowing whether 'life imprisonment' includes the possibility of parole. Defendants in such cases must have the right to appellate review of juror understanding of instructions, to avoid capricious use of the death penalty.
