NASHVILLE - A proposal that would require informed consent before an abortion has been delayed to allow senators a chance to see how the House acts on the measure.
The Republican-controlled Senate Judiciary Committee voted 5-4 on Tuesday to delay the measure sponsored by Sen. Roy Herron until April 16.

SALT LAKE CITY -- Medical clinics performing abortions would be required to display any ultrasound images of a pregnant woman's fetus taken prior to the procedure if she chooses to see them, under a bill approved 53-15 in the House on Friday.
HB200, which addresses the informed consent portion of state abortion statutes, also would require clinics to give a detailed description of the ultrasound images if the woman asks for the information.

Editor, the Tribune: Missouri Right to Life applauds the Missouri House for voting to expand the informed consent laws on abortion. House Bill 1831, sponsored by Republican Rep. Bob Onder, requires that a mother be offered an ultrasound, be informed about her child's ability to feel pain and be protected from coercion.
It's difficult to understand how anyone could oppose legislation that allows a pregnant woman to see her baby's heartbeat or to learn about her unborn child's development.

Pity House Health and Human Resources Committee Chairman Don Perdue, D-Wayne, who going into the final week of the regular session has the two hot-button issues of the session in his committee: the fetal ultrasound bill (SB597) and the optometrists/ ophthalmologists turf war bill (SB230).
Going into Friday, the sense was that abortion-rights advocates in the House were close to conceding the ultrasound bill, particularly since compared to requirements already on the books for informed consent for abortion, the opportunity to view an ultrasound is comparably innocuous.

Unborn fetuses were the focus of a trio of legislative proposals that passed Thursday out of the state House Judiciary Committee.
A bill requiring informed consent of the patient and parental notification prior to an abortion was approved without debate. The measure would require physicians who perform abortions to inform the woman of the availability and location of state printed materials. Also required will be parental notification, although Rep. Kevin Calvey, R-Del City, said consent of the parents will not be a requirement. Calvey is the author of the bill.

[...] scholars argue that consent searches are not supported by the Constitution on their face because "reasonable" searches are founded on probable cause, and consent does not,per se, provide law enforcement officers with the requisite probable cause to validate a search.17 Second, condemning the weak standard of "voluntariness" by which courts determine the validity of a person's consent,18 scholars question whether an individual's consent can ever be genuinely voluntary in the face of government authority.19 If consent cannot possibly be given voluntarily in the face of government authority, then all consents are coerced, which renders all consents constitutionally invalid.20 The doctrinal justifications for targeted-party consent searches have been roundly criticized. A targeted-pa...
