• 10th Circuit Says Recovering Drug Addict Can't Sue Under Ada

A recovering drug addict could not sue for disability discrimination when he was denied reinstatement to his former job after completing a drug treatment program, the 10th Circuit has ruled in affirming a summary judgment. The Americans with Disabilities Act (ADA) provides that an employee is not "a qualified individual with a disability" if he "is currently engaging in the illegal use of drugs.
