In March 2002 Atallah filed an action in federal court under the PMPA. Lq October 2002, discussions began to settle the federal action between Equilon and Atallah. Most of the settlement terms were agreed upon by February or March 2003. On April 14, 2003, Atallah signed the settlement agreement that provided that Equilon would sell the gas station to Atallah for $759475 and would also pay Atallah $90j000 for the early termination of his franchise agreement.
