WHITTIER - A court will determine if a Whittier man who allegedly held a pair of scissors to a woman's throat at the library and demanded a pound of marijuana is mentally competent to stand trial. Deputy District Attorney Lance Hansen said Ignacio Munoz, 30, appeared in Whittier Court on May 24 for a preliminary hearing, but the defense attorney raised doubt about Munoz's competency.

The present system of determining incompetency to stand trial as a criminal defendant is poorly structured, wastes time and money, and makes inaccurate determinations. Giving counsel primary authority to determine competency would improve the process, as the question in this context is largely a legal rather than clinical one. The process should presume competency when the defendant accepts counsel's recommendation or counsel supports the defendant's choice. This would also improve treatment where needed.
