Trial court erred by not imposing maximum sentence and additional term of imprisonment for defendant found to be a repeat violent offender.
NEW YORK, May 24 /U.S. Newswire/ -- Shahawar Matin Siraj was convicted today by a federal jury in Brooklyn of conspiring to plant explosive devices at the 34th Street subway station in Manhattan in August 2004, just prior to start of the Republican National Convention at nearby Madison Square Garden. The verdict was announced today by Roslynn R. Mauskopf, United States Attorney for the Eastern District of New York, after five weeks of trial. Siraj faces a maximum sentence of life imprisonment. Siraj remains held without bail, where he has been since his arrest on August 27, 2004. Siraj is the second individual convicted for participating in this plot. A plea agreement authorizing a particular sentence does not preclude a defendant from later seeking a reduction in his term of imprisonment pursuant to amended guidelines for crack cocaine offenses, the U.S. Supreme Court has ruled in a 5-4 decision. The ruling reverses a decision from the 6th Circuit.
A man convicted of beating his ex-girlfriend and holding her against her will for several hours despite the serious injuries she sustained has failed to convince the Court of Appeals that the sentence he received was illegal. A Prince George's County Circuit Court jury found Robin Tyronne Cathcart guilty of first degree assault and false imprisonment of Antoinette Drayton. For the false imprisonment, he sentenced Cathcart to life in prison with all but 10 years suspended; for the assault, he received a 10-year sentence.
The second robbery occurred the next day on October 14,2004 in the lobby of an apartment building on Featherbed Lane. [Hoyt Phillips]' 40 year old victim was robbed of a necklace, earrings and other jewelry as she got off an elevator. On October 15, 2004, Phillips accosted a 21-year-old pharmacy student in the lobby of an apartment house on the Grand Concourse and forced her to turn over an iPod and approximately $200 in cash. Several days later on October 19, 2004, Phillips confronted a 40-year-old woman and her 14-year-old son in the lobby of an apartment building on Grand Avenue.
