The question of whether the Constitution imposes an age limit on being sentenced to life in prison left the justices of the U.S. Supreme Court struggling over where to draw difficult lines on March 20th. The cases, Miller v. Alabama and Jackson v. Hobbs, were taken up separately by the Court, but argued in tandem. Both cases involve teens who were convicted of capital murder committed when each defendant was 14 years old.
RANCHO CUCAMONGA -- An off-duty police officer and off-duty state corrections officers could face life in prison if convicted of criminal charges filed by prosecutors today in a woman's alleged kidnapping and rape. Anthony Nicholas Orban and Jeff Thomas Jelinek, both 30, are expected to be arraigned Wednesday this morning in West Valley Superior Court in an 11-count criminal complaint.
Last September, three men were tried together in Baltimore City Circuit Court for the murder of former Baltimore City Councilman Kenneth Harris. Given that the charges carried the possible sentence of life imprisonment and there were multiple defendants, Judge David Ross, a retired judge recalled to handle the case, was faced with a daunting challenge: how to assure that there were enough qualified jurors to try the case. Under Maryland Rule 4-313 and Section 8-420 of the Courts and Judicial Proceedings Article, where imprisonment for life is possible, each defendant in a multiple defendant case is entitled to 20 peremptory strikes, and the State is permitted 10 for each defendant in selecting the 12 jurors.
Sentencing juveniles to life in prison without parole for non- murder crimes is unconstitutionally cruel and unusual, the U.S. Supreme Court has ruled. That opinion in Graham v. Florida is one of four case dispositions by the Court today. The Court also dismissed a similar case, Sullivan v. Florida, as improvidently granted. That case also involved a juvenile who was sentenced to life without parole for a non-murder charge, but it was not consolidated with Graham because of the differences in facts and procedural history.
On August 26, 2005, nine months after being paroled for the attempted robbery in 1994, [Kwame Hoden] was arrested with two other men on charges including robbery and illegal gun possession. Hoden 's co-defendants, one of whom testified against him at trial, pled guilty to the robbery. After five days of deliberations, the jury convicted Hoden on the gun charge, but could not reach a verdict on the robbery charges.
On July 19 the three teens appeared before Palm Beach County Circuit Judge Paul Moyle, who noted that each of the offenses consti-tuted a "life felony," meaning that they could result in imprisonment for life. According to Mike Edmondson, spokesperson for the State Attorney's Office, the police are still investigating the case with other suspects still at large. A man convicted of beating his ex-girlfriend and holding her against her will for several hours despite the serious injuries she sustained has failed to convince the Court of Appeals that the sentence he received was illegal. A Prince George's County Circuit Court jury found Robin Tyronne Cathcart guilty of first degree assault and false imprisonment of Antoinette Drayton. For the false imprisonment, he sentenced Cathcart to life in prison with all but 10 years suspended; for the assault, he received a 10-year sentence.
