A "mental health" clause in an ERISA insurance plan did not apply to limit coverage of an insured's hospitalization for malnutrition relating to an eating disorder, the 8th Circuit has ruled in reversing judgment.
The plaintiff was hospitalized for 40 days due to severe malnutrition when she was 15 years old.

Double-digit increases in hospitalization insurance premiums and a doubling of state retirement costs, coupled with decreases in revenue, mean residents will shell out more for their town tax bill next year, according to the town's top elected official.

Seventy-five-year-old Thomas Duncan* never expected that he would lose his health insurance. He had an individual policy with a major insurance provider that he had held for over 15 years. It wasn't until just a few months after his emergency bypass heart surgery that he received a letter in the mail from his insurance company informing him that his coverage was being terminated due to a missed premium.
