HYDERABAD, India, February 7, 2011 /PRNewswire/ -- Commonwealth Secretary-General Kamalesh Sharma has praised India's justice system for being the guardian of the nation's constitution. He said the Indian Supreme Court has played a pivotal role in interpreting and championing human rights. Sharma applauded the landmark decision of the New Delhi High Court in July 2009, which decriminalised homosexual acts conducted in private by consenting adults. The Secretary-General said this was clear evidence of the judiciary's commitment to securing human rights for all, on the basis of non-discrimination.
NEW DELHI -- A court in India has made a groundbreaking ruling to decriminalize consensual gay sex in the capital of the deeply conservative society. The Delhi High Court ruling, the first of its kind, applies only in New Delhi. The ruling says that treating consensual gay sex as a crime is a violation of fundamental rights protected by the constitution.
