The late 1980s and early 1990s were not the best years to own a thrift -- unless your institution was Guaranty Bank and you had plenty of money to lend and a cache of experienced unemployed bankers from which to hire. Guaranty Bank was created in 1988 as a Southwest Plan thrift. It was formed from three insolvent thrifts -- Delta Savings of Alvin, First Federal Savings of Austin and Guaranty Federal Savings in Dallas. A federal judge has denied Guaranty Bank's request that it be allowed to halt payments to an insurance company despite Guaranty's contention that continuing to pay millions of dollars in premiums each month threatened the bank's survival.
In February, Guaranty asked the court to let it stop paying premiums to Evanston Insurance Co. of Deerfield, Ill, but nonetheless keep the insurer's coverage on its home-equity loan portfolio intact. Guaranty also sought the return of $30 million in premiums paid since 2004, contending the policy was sold to the bank illegally under Wisconsin insurance law.

Guaranty Bank, which has been losing money and is under pressure by regulators to strengthen its financial position, says in a federal court filing that the bank will go out of business unless a judge lets it halt premium payments to an insurance company.
In court documents connected to a lawsuit against the insurer, Guaranty said it needs an injunction that will immediately stop the premium payments of at least $3 million a month -- but still keep the policy active -- or it will not be able to abide by regulators' orders to beef up capital and won't survive long enough to resolve the suit.

Guaranty Bank, which has recorded 11 consecutive quarterly losses and is under scrutiny from regulators, is exiting what has been the most unprofitable part of its mortgage lending business.
Guaranty, of Brown Deer, said it will close its GB Mortgage subsidiary, a unit that has provided funding for independent mortgage brokers writing mortgages around the United States. As the housing slump has dragged on and home prices have continued falling, GB Mortgage has taken losses, many of them from second mortgages on residential properties.
