A teen convicted of trying to kill two people at a Silver Spring bus stop will get a new trial, after a split Court of Appeals yesterday faulted the trial judge for, in effect, becoming an advocate for the State during the prosecution of Francesco A. Kelly. Montgomery County Circuit Judge Michael D. Mason erred in requiring defense counsel to proffer the testimony of her witnesses - without an objection from the prosecution, and without obliging the state's attorney to do the same - and then declining to let those witnesses testify after concluding their testimony would constitute hearsay.

A convicted child molester who during trial objected to the admission of a videotaped interview with his victim on the grounds that it was hearsay cannot now have the Court of Special Appeals examine whether it violated the Confrontation Clause of the Constitution - even though the U.S. Supreme Court decided a landmark case on the issue just days after his sentencing. Evidence of a burglary obtained after a home visit to two probationers was admissible in court, the Court of Special Appeals has held.In 2002, Robert Volkomer was a suspect in a break-in at an animal hospital in Wicomico County. Since both he and his wife, Emma, were on probation in Delaware, a probation officer went to their house and conducted a cursory search, called a home visit.During that visit, an officer discovered a plastic bag filled with boxes of ketamine, an animal tranquilizer. A judge was right to give a flight instruction in the trial of a man convicted of shooting a businessman visiting downtown Baltimore City, even though the defendant gave a different excuse for running from police, the Court of Special Appeals has held. Warren Thompson admitted he ran from police, but claimed it had nothing to do with the shooting. Instead, he said he ran because he was dirty, that is, carrying 86 vials of cocaine.

The Court of Special Appeals has ordered a new trial in an Eastern Shore drug case, finding that prosecutors wrongfully withheld evidence from the defense. Richard J. Massey Jr.'s attorney was entitled to a copy of the report prepared by the police officer who found drugs in his car, even though the state did not use the report in its direct examination of Officer Michael Bond.

A Montgomery County man did not violate the law against driving in excess of a reasonable and prudent speed by drinking and driving 55 miles per hour in a 40 mph zone, the Court of Special Appeals has held. Jon Patrick Warren will still have to serve a 60-day prison sentence, all but 30 days suspended, for his driving while impaired conviction.

The crime of stalking does not require that the stalker approach or pursue the victim, the Court of Appeals has held. Wendell Hackley was convicted in Prince George's County Circuit Court of second-degree assault, reckless endangerment and stalking for repeatedly leaving letters and a backpack for the mother of his child after he pistol-whipped her. He challenged his conviction before the Court of Special Appeals, arguing that stalking requires approaching or pursuing the victim, not simply leaving items for her.
