LOS ANGELES (AP) -- Proving that no good deed goes unpunished, the state's high court on Thursday said a would-be Good Samaritan accused of rendering her friend paraplegic by pulling her from a wrecked car "like a rag doll" can be sued.
California's Supreme Court ruled that the state's Good Samaritan law only protects people from liability if they are administering emergency medical care, and that Lisa Torti's attempted rescue of Alexandra Van Horn didn't qualify. Justice Carlos Moreno wrote that a person is not obligated to come to someone's aid.

DEAR ABBY: "Horrified in Dover, Del." (May 30) describes a classic example of what psychologists call "Bystander Syndrome." It's a sad fact that the majority of people pass by an accident or simply stand and watch without helping because they figure that "somebody else" will do something. In many cases, nobody does anything, which can lead to serious consequences.
That is why it's important that people be familiar with basic first aid and not hesitate to take action when they see a crisis unfolding. And if you need something done for you, specifically select someone from the crowd, and indicate clearly to that person what you need. A state Good Samaritan law does not bar a negligence claim against an individual who allegedly injured the plaintiff by removing her from her vehicle after an accident, the California Supreme Court has ruled.
The defendant was a friend of the plaintiff who was driving in a separate car when the plaintiff's car slammed into a light post.

Although insurance agents and brokers accept many duties owed to their customers, they are not guarantors of every problem that may face an insured. In Boyer v. Wells's case, the California Court of Appeal ruled that an insurance agent only needs to fulfill duties actually assumed and that unless the agent makes specific promises, the agent is not obligated to an insured. In Boyer v. Wells, the insured failed to pay his premium and tried to blame cancellation on the agent who failed to force him to pay. Whether a duty of care exists is a question of law for the court.
