Consumers could sue an international drug firm under state antitrust law for allegedly conspiring with generic drug manufacturers to charge customers inflated prices for an antibiotic because the statute doesn't apply only to distinctly intrastate conduct, the Wisconsin Supreme Court has ruled in reversing a dismissal.
The state antitrust act provides that "[e]very contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce is illegal." The act authorizes the recovery of treble damages for "any person directly or indirectly injured by such a practice." The state supreme court previously decided that the act applies to interstate conduct "if the conduct 'substantially affects' the people of Wisconsin and has 'impacts' in this state.

NEW YORK -- Wal-Mart, the world's largest retailer, plans to slash the prices of almost 300 generic prescription drugs, offering a big lure for bargain-seeking customers and presenting a challenge to competing pharmacy chains and makers of generic drugs.
The drugs will be sold for as little as $4 for a month's supply and include some of the most commonly prescribed medicines such as Metformin, a popular generic drug used to treat diabetes, and the high blood pressure medicine Lisinopril.

TRENTON, N.J. - Finally, a little good health care news for consumers: U.S. prices for generic prescription drugs, which already cost as little as one-third what their brand-name cousins do, have been getting cheaper and likely will keep doing so.
The causes? The ultra-low prices for generic prescriptions offered by giant retailers and drugstore chains and intense competition among the many generic drugmakers fighting for sales, according to health information firm IMS Health.
