Certain government-owned properties are quintessentially public for free-speech purposes. Municipalities across the country, however, are selling streets, sidewalks, and parks to private actors without consulting the citizens who benefit from the property. Selling a public forum provides a municipality with more money for projects that benefit citizens. On the other hand, privatizing small sections of streets, sidewalks, and parks could lead to a confusing patchwork of public and private property that would leave citizens unsure of their free-speech rights.
