Ina Garten, the Food Network's "Barefoot Contessa," will headline a fundraiser for independent gubernatorial candidate Eliot Cutler this month in Portland. Cutler is on the Nov. 2 ballot along with Republican Paul LePage, Democrat Libby Mitchell and independents Shawn Moody and Kevin Scott.
A criminal defendant's pension may be garnished to pay restitution to his victims - the benefits are not protected by ERISA's anti-alienation provision, the en banc 9th Circuit has ruled. The court of common pleas acted within it discretion in concluding that the Real Estate Commissions revocation of appellants real estate license was unsupported by reliable, substantial and probative evidence. Trial court properly concluded that the Real Estate Commission erred when it concluded that appellant violated R.C. 4735.18(A) by failing to promptly reimburse improperly garnished funds.
Individual retirement account, Vorwald case The Tax Court ruled in a memorandum opinion in Vorwald that an ex-husband whose individual retirement account was garnished for child support arrearages was subject to income taxation and an early distribution 10% penalty on the distribution. The garnishment, paid directly to his ex-wife, was a distribution to the taxpayer despite the fact that he only learned of the garnishment after the fact. Section 408(d)(6), which provides for a tax-free transfer of an interest in an individual retirement account pursuant to a divorce agreement, was not applicable.

A federal judge has given the OK to garnish the retirement payments of a former Mississippi River riverboat pilot who pleaded guilty to not paying federal taxes. S. Attorney Jim Letten today said Judge Carl J. Barbier ruled that Clifford E. Clayton's $180,000 annual retirement payments and approximately $55,000 in other payments from the New Orleans-Baton Rouge Steamship Pilots Association can be garnished to pay the back taxes.
A divorced doctor's accounts receivable are subject to garnishment for delinquent spousal support payments, the Kentucky Court of Appeals has ruled. A couple divorced after 22 years of marriage. During the marriage, the husband's income regularly exceeded $200,000, but the wife hadn't worked outside the home.
