In an interview, Spiros Bazinas, senior legal officer, UN Commission on International Trade Law (UNCITRAL), talked about the importance of UNCITRAL and provides readers with an update on the Commission's work to promote effective secured transactions law around the world. The United Nations General Assembly established the UNCITRAL in 1966 with the general mandate to further the progressive harmonization and unification of the law of international trade. There are four phases in UNCITRAL's long involvement in work on security interests in movable property. The first phase is a preparatory one. The second phase in UNCITRAL's work on security interests in movable property began with a Congress on International Trade Law. The third phase of UNCITRAL's work on security interests in movable ...

The dead-hand rationale for the Rule is best understood as a response to the disagreeable consequences that can arise from unanticipated circumstances.10 The Rule implements this anti-dead-hand policy by curbing future interests that, after some period of time and change in circumstances, tie up the property in potentially disadvantageous arrangements. At issue was the will of Peter Thellusson, an enormously rich merchant and financier who died in 1797.14 Thellusson's will provided that the bulk of his considerable estate, plus all the income it would earn during the lives of his nine surviving male descendants, should be accumulated for the ultimate benefit of his oldest surviving male descendant at the end of that period.15 Thellusson thus deviated substantially from the normal pract...

State Agriculture Commissioner Gus R. Douglass will leave a long legacy when he retires from the Department of Agriculture next year. Hell also leave behind some confusion. Its not his fault. West Virginia law says the agriculture commissioner shall be a practical farmer, learned in the science of agriculture, and shall have made agriculture his chief business for a period of ten years immediately preceding his election. Douglass is a lifelong farmer and still lives on the 540-acre farm where he grew up. But as candidates start lining up to take his office, state officials may soon be asking complicated questions. What is a practical farmer, for instance? And how much of a candidates income needs to come from farming for it to qualify as their chief business? The answer is as clear as m...
State courts have adopted different approaches to valuing contaminated properties for purposes of awarding just compensation in eminent domain proceedings. Of the states that have adjudicated this issue, the majority have held that evidence of contamination is admissible under the principle that market value is the best measure of just compensation and contamination is relevant to market value. A minority exclude contamination evidence to avoid penalizing the condemnee for contamination twice: once in the form of a reduced compensation award and again when the condemnee is held liable for remediation costs in a cost- recovery proceeding. A few states have adopted a third alternative, the trust- escrow approach, which omits evidence of contamination during the condemnation proceeding and...
