Thirty years ago I graduated from a state-operated segregated boarding school for kids with disabilities. This was a dismal place with a bare-bones curriculum. Mainstream public schools were not required to accept kids like me who used wheelchairs or had any other disabilities, so my mother had little choice but to send me there. The next year the landmark federal law now known as the Individuals with Disabilities Education Act was passed. It declared the right to a free and appropriate public education for all students with disabilities. Leading up to the act, Congress noted that more than 1 million children with disabilities were receiving no education at all.
House Bill 115, or the Carson Smith Special Education Scholarship Bill, on the surface sounds like a good idea; however, there are some real problems with the legislation. The major challenge in this legislation is the requirements of the federal law as it relates to the State School Board and the inclusion of the State School Board into the governance of a private school provider. This inclusion comes in the form of rule-making authority for the State School Board and approval of eligible private schools for public funds. This bill also has challenges related to responsibility of public schools to provide an assessment for children in private schools.
