A car dealer forfeited its right to enforce an arbitration clause in its customer agreement when it responded to a putative class action for failing to adequately disclose finance charges, the California Court of Appeal has ruled in affirming judgment. The plaintiff purchased a car from the defendant. According to the plaintiff, the defendant required her to execute multiple retail installment contracts for the transaction, the final agreement being backdated to the original date of purchase. The plaintiff alleged that the practice was illegal and resulted in her incurring undisclosed finance charges in violation of state consumer protection law.

• Kanawha County Cashing in On Backlogged, Forfeited Bail Money

It might have taken more than 20 years, but the Kanawha County courts are finally cashing in on the tens of thousands of dollars in forfeited bail bond money that has languished in the court system for decades. On Wednesday, Magistrate Court officials held the first of two hearings to talk to the more than 500 citizens who collectively posted more than $145,000 in bail for defendants who then skipped their scheduled court appearance.
