For a quarter of a century lawyers had been drafting debentures in accordance with the principles established in the case Siebe Gorman Ltd v Barclays Bank Ltd (1979) 2 Lloyd's Rep 167. Now the Law Lords have overruled that decision, but they have also had to deal with the consequences. Slade J in the Siebe Gorman case explained that there could, however, be a fixed charge over a fluctuating asset, provided that the financier restricted the company's power to deal with it in the ordinary course of business. A Niagara Falls woman with a history of selling cocaine in Lockport was arraigned on a new indictment in County Court, charging her with doing that again. Jeanine L. Burton, 20, of LaSalle Avenue, pleaded not guilty to two counts each of third- degree sale and third- and seventh-degree possession of a controlled substance. County Judge Matthew Murphy III, who had sent her to jail last year for violating her probation on a conviction for selling cocaine in Lockport in 2009, set bail at $20,000. Co- defendant Murray Cunningham Jr., 21, of no fixed address, faces the same six charges as Burton; Cunningham has yet to be arraigned.
