The perfect storm continues to build against not sufficient funds (NSF) programs. As a result, bankers should act now to safeguard themselves against the likely regulatory offensive aimed at such programs. Customers desire such products and often are willing to switch banks to obtain them. For most banks, a NSF program is the most profitable part of their service fee income. Washington Mutual reported that it earned in excess of $1 billion from its overdraft program in 2003. These NSF programs are now entering the choppy waters of the approaching storm. A NSF Program is a program whereby depositors are given the ability to write checks beyond the cash balances they have in their checking accounts, up to some pre-determined level. Although the checks do not bounce, the bank charges an overdraft or NSF fee for each item beyond the balances in the account. For most banks, A NSF program is the most profitable part of their service fee income. Five areas will be the focus of regulatory inquiry: 1. compliance, 2. risk assessment, 3. unfair and deceptive acts, 4. vendors, and 5. usury-aiding and abetting bouncing checks.
