• 9th Circuit Rules Lender Not Liable for Failing to Refund Finance Charge

The maker of a tax refund anticipation loan is not liable under federal law for failing to refund a portion of its flat finance fee when the borrower repaid the loan early, the 9th Circuit has ruled in affirming a dismissal. The federal Truth in Lending Act states that "[i]f a consumer prepays in full the financed amount under any consumer credit transaction, the creditor shall promptly refund any unearned portion of the interest charge to the consumer. The plaintiff in this case obtained a short-term loan from the defendant secured by her anticipated federal income tax refund.
