The rate of consumer bankruptcy filings increased more after the issuance of the rebate checks in 2008 than it did after the 2001 rebates, a new report finds. It suggests the 2005 Bankruptcy Abuse Prevention and Consumer Protection Act bars those most in need from filing for bankruptcy.

Bankruptcy filings in Western New York continued to decline by more than 20 percent in October, as tightened credit, the cost of filing and fewer foreclosures kept debtors out of court.
According to the U.S. Bankruptcy Court for the Western District of New York, filings of new cases in October fell 26.4 percent, to 531 from 721 a year ago. That's the lowest tally since January and the lowest for the month in at least a decade.
