The inadvertent production of privileged documents promises to become more frequent as discovery becomes more complex. The amended Federal Rules of Civil Procedure and proposed Federal Rule of Evidence 502 address concerns regarding procedural and substantive privilege law as it relates to inadvertent waiver of privileged documents. The rules purport to respond to increasingly burdensome complexities of electronic discovery and the resulting conflicts over the ability of parties to enter into agreements and protective orders contracting around waiver. This Note suggests that attorneys should continue to take reasonable precautions to avoid producing privileged information.
