This article discusses the community of alternative dispute resolution (ADR) professionals that has evolved as courts have incorporated ADR programs into the justice system. The article describes a number of challenges confronting court ADR programs, as well as efforts generated from within the community to confront those challenges. The article describes development of the Federal Judicial Center's Program for Consultations in Dispute Resolution and how the FJC designed and implemented this program, through which judges, ADR administrators, and researchers provide assistance to their peers in federal court ADR programs. Steven J. Kelly, of the Baltimore office of Miles & Stockbridge, recently received the National Crime Victim Law Institute's 2011 Legal Advocacy Award for his work on behalf of crime victims and their families. Kelly has worked with the organization at the trial and appellate levels in litigation on such issues as the victim's right to address the court at sentencing, restitution, privacy of medical and counseling records, and the rights of sexually exploited children. His practice includes defending the rights of crime victims in criminal proceedings and representing victims of accidental injuries. Most federal judges tell jurors not to use Facebook, Twitter and other social networking tools to communicate information about the trials in which they are sitting, according to the results of a survey conducted by the Federal Judicial Center.
About 96 percent of federal judges surveyed said they have taken preventative measures to keep jurors from using social media during trials and deliberations. About 60 percent of judges said they have used the model jury instructions regarding the use of electronic technologies. The model rules were distributed in 2010 to address social media use. Other judges reported using their own jury instructions to warn jurors.
