The U.S. Supreme Court regrettably has left broadcasters subject to FCC punishment for airing unplanned, fleeting vulgarities. But in doing so it offers the welcome prospect of a badly needed update of applicable laws and rules.
A five-justice majority stopped short of deciding Federal Communications Commission et al. v. Fox Television Stations Inc. et al. on constitutional grounds. Instead, it ruled that a tougher FCC stance after expletives aired live on two music award shows was not "arbitrary" or "capricious.
