The D.C. Circuit has dismissed the American Bar Association's case against the Federal Trade Commission over the application of the agency's "red flags" rule, ending a long-running legal saga.
In a ruling issued Friday, the court held that the passage last December of the Red Flag Program Clarification Act, which exempts attorneys from the rule, rendered the case moot.

President Bush's nominee to fill the Maryland vacancy on the 4th U.S. Circuit Court of Appeals has received the American Bar Association's highest rating for federal judge candidates. The ABA's Standing Committee on the Federal Judiciary unanimously voted to give Rod J. Rosenstein, U.S. Attorney for Maryland, a "well qualified" rating. The 15-member committee investigates candidates for integrity, professional competence and judicial temperament and rates them as well qualified, qualified or not qualified. The 4th Circuit is authorized to have 15 judges but, through a combination of deaths, retirements and resignations, only has 10 active members now.
