Criminal violations under the False Claims Act
The False Claims Act, first enacted in 1863, permits private individuals to bring suit in behalf of the federal government for fraudulent claims against it. The Act is also enforceable by criminal penalties. Elements of a False Claims Act criminal violation include the knowing presentation of a false, fictitious, or fraudulent claim to the government. Defenses include lack of the required intent and double jeopardy. Penalties include fines, imprisonment, and denial of collateral estoppel protection.

Heightened fraud enforcement has been employed as a way of controlling health care costs. The main weapons that have been employed include criminal prosecution under the False Claims Act or the Medicare and Medicaid Anti-Kickback Act; civil prosecution under the Civil False Claims Act, including qui tam provisions, or the Civil Monetary Penalties Act; and mandatory exclusion from participation in Medicare and Medicaid. A more flexible system, without mandatory exclusion, would result in a more effective remedial program. Investigations of National Medical Enterprises and Caremark International are discussed.
