Simply put, it is unlawful for an advertiser to make statements which are false or misleading about the nature, characteristics, qualities or geographic origins of its or a competitor's goods, services or commercial activities. To preserve the First Amendment right of free speech, the reach of Section 43(a) extends only to commercial speech as defined by the U.S. Supreme Court. Commercial speech is afforded less constitutional protection than other types of speech and can be significantly restricted.
