  • The Court of Justice of the European Union (CJEU) has ruled that Belgian must-carry rules are incompatible with EU law, as they lack clearly defined, ...

  • It is suggested that a multilateral tax treaty between the United States and the EU countries is the most comprehensive way to solve conflicts between EC law and current bilateral US-Member State tax treaties while preserving the tax sovereignty of the EU countries. A single multilateral treaty could replace more than 300 intraEU and US-EU Member State bilateral tax treaties. The United States and each of the EU Member States have greatly varying domestic tax systems and each country has different policy goals it would like to achieve through tax treaties. Gaining consensus among such a large group of countries would be difficult, particularly since the profile of the new Member States differs from that of the old Member States. The new Members are less developed, and their interests do...

  • The U.S.-EU Extradition Agreement contains several provisions that should improve the scope and operation of bilateral extradition treaties in force between the United States and each EU Member State. For example, it requires replacing outdated lists of extraditable offenses included in 10 older bilateral treaties with the modern ''dual criminality'' approach, thereby enabling coverage of such newer offenses as money laundering.

  • Playwright Henry Fielding took advantage of a storm-enforced stop in Devon one July in the middle of the 18th century to pay cash for a hogshead of cider and to take it with him to Lisbon. Around 250 years later there was no cash for the seller, or the shipper, of 11 container loads of the amber liquid. This illustrates both the problems for managing credit in such cross-border transactions in the European Union, and the need for clarity in the complicated paperwork. Article 5(1)(b) of the Council Regulation (EC) No. 44/2001 was the most relevant for the export of the cider, because it states that where there is a sale of goods, and unless otherwise agreed, the place of performance of the relevant obligation is the EU member state, where they are delivered. The contract of carriage must...

  • The U.S.-EU Mutual Legal Assistance Agreement contains several innovations that should prove of value to U.S. prosecutors and investigators, including in counterterrorism cases. The Agreement creates an improved mechanism for obtaining bank information from an EU Member State, elaborates legal frameworks for the use of new techniques such as joint investigative teams, and establishes a comprehensive and uniform framework for limitations on the use of personal and other data.

  • Poland is a member of European Union which has joined the Schengen System recently. However, the EURO currency has not been introduced yet. Since the EU law does not affect directly the judicial procedures of any EU Member State, the debt collecting issue is left to each State's exclusive competence. The time limitation for the claims in commercial claims is three years, which is interrupted by taking any legal proceeding. The first step to be taken by the creditor in order to recover debts is usually an attempt to settle a dispute amicably. The parties may agree to settle a dispute amicably by arbitration court ad hoc or permanent (domestic or foreign). In case when the creditor's claim is properly proven by written documents the application for the court order may be filed either in t...

  • LONDON (Reuters) - European Union president Spain tightened proposed rules to regulate hedge funds and private equity groups, prompting accusations of protectionism from within the industry but potentially speeding up moves towards a deal. Spain recommended non-E.U. funds should only be marketed in a member state if "appropriate cooperation agreements" are in place between regulators of the countries involved. The presidency's previous proposal had maintained the status quo by saying E.U. states should be allowed to have third country funds on their turf unhindered.

  • The new extradition treaty with Estonia would replace the outdated extradition treaty between the United States and Estonia, signed on November 8, 1923, at Tallinn, and the Supplementary Extradition Treaty, signed on October 10, 1934, at Washington. The treaty also fulfills the requirement for a bilateral instrument between the United States and each European Union (EU) Member State in order to implement the Extradition Agreement between the United States and the EU.

  • Helle Dale's Oct. 5 Op-Ed column, "At the crossroads," is another example of attempting to invoke the "Christian vs. Muslim" element as it relates to Turkey's accession into the European Union. Although I'm sure there are many, on both sides, who would like to use this argument, the simple truth is that there are basic fundamental prerequisites for gaining membership into the union. Turkey falls short in many. Isn't Turkey occupying Cyprus? Isn't Turkey refusing to recognize Cyprus, an EU member state? Isn't Turkey violating its neighbor's borders in the Aegean? Isn't Turkey restricting religious freedom of minorities in Turkey? Doesn't the military establishment heavily influence the Turkish government? Does the Turkish economy meet the EU criteria?
