The law of limited consent searches allows the police to gain entry to a premises without informing the suspect that limiting the scope of the search does not effectively restrict what the police may seize if other incriminating objects are in plain view. The 'plain view' doctrine invites the use of pretextual consent searches by police. The police should be required to inform consenting suspects prior to limited searches that incriminating items other than the stated objects of the search will be subject to seizure and be used against them if discovered in plain view.
