Recognizing that the gender wage gap was in fact at least partially caused by discriminatory employment practices, Congress enacted the Equal Pay Act of 1963 (EPA) to supplement preexisting labor law statutes. The EPA unequivocally prohibits employers from paying male and female employees working comparable jobs different wages solely based on an employee's sex. However, it is also narrowly tailored to protect legitimate business practices. While fear of overly-intrusive judicial activism interfering with long standing business employment practices is a valid concern, a court's unwillingness to hold employers to the strict standards mandated by Congress is equally problematic.
