  • As the number of cases alleging family responsibilities discrimination continues to rise, the Equal Employment Opportunity Commission recently issued guidelines to address the topic. According to the agency, its guidelines on "Unlawful Disparate Treatment of Workers with Caregiving Responsibilities" are intended to "assist investigators, employees and employers in assessing whether a particular employment decision affecting a caregiver might unlawfully discriminate" and to "illustrate circumstances" in which stereotyping or other forms of disparate treatment may violate an employee's rights.

  • In May of 2007 in response to a perceived "potential for greater discrimination against working parents and others with caregiving responsibilities", the United States Equal Employment Opportunity Commission (EEOC) issued new enforcement guidance addressing Unlawful Disparate Treatment of Workers with Caregiving Responsibilities (EEOC-A, 2007). On April 22, 2009, the EEOC issued additional guidance to employers, Employer Best Practices for Workers with Caregiving Responsibilities, offering "proactive measures that go beyond federal non-discrimination requirements" (EEOCB, 2009). These guidelines are designed to reduce employers' exposure to litigation for "violations against caregivers, and to remove barriers to equal employment opportunity" (EEOC B, 2009). This paper examines the initi...

  • The Regulatory Flexibility Act requires that agencies publish semiannual regulatory agendas in the Federal Register describing regulatory actions they are developing that may have a significant economic impact on a substantial number of small entities (5 U.S.C. 602). Executive Order 12866 ``Regulatory Planning and Review,'' signed September 30, 1993 (58 FR 51735), and Office of Management and Budget memoranda implementing section 4 of that Order establish minimum standards for agencies' agendas, including specific types of information for each entry. The Unified Agenda of Federal Regulatory and Deregulatory Actions (Unified Agenda) helps agencies fulfill these requirements. All Federal regulatory agencies have chosen to publish their regulatory agendas as part of the Unified Agenda. Edi...

  • Within the next 12 to 18 months, employers can expect to see the US Equal Employment Opportunity Commission (EEOC) issue new guidelines that require empirical evidence for the "business necessity" defense in racial discrimination cases that arise from screening and hiring practices, according to Rod Fliegel, a partner at Littler Mendelson in San Francisco. Sensationalized headlines about workplace homicides and inflated vendor claims paint a dramatic picture of workforce criminality and criminal screening as an effective risk-reduction practice. To construct new guidelines for screening and hiring, the EEOC will draw from testimony given in its November 2008 hearings and from the 3rd US Circuit Court of Appeals' 2007 decision in the case of El v. SEPTA, according to Fliegel, who represe...
