Justice Anthony Kennedy is the Supreme Court's crucial voice in environmental law cases. Kennedy's central role was never more evident than in the two most celebrated environmental cases of the last few years, Kelo v. City of New London and Rapanos v. United States, as he supplied the critical vote in both. Kennedy has in fact been the needle of the Supreme Court's environmental law compass since his nomination in 1988. Environmental law cases decided by the US Court of Appeals from the 9th Circuit in 1994 are surveyed. Issues highlighted from the cases surveyed include environmental quality such as toxic torts, hazardous waste, and clean air; native rights; property rights such as mining on public lands; natural resources issues such as water quality, wildlife, endangered species, forests, and hydroelectric power; and litigation issues and constitutional challenges. In-depth issues include decisions on Land and Resource Management Plans (LRMPs), the parens patriae doctrine, and transportation planning under the Clear Air Act.
