An accounting firm bought a professional liability insurance policy from a broker's subagent. The broker obtained the policy through a managing general agent. On or about Jul 2, 1997, the accounting firm's president was notified of a potential professional liability lawsuit, to be filed by one of the firm's clients. Nearly six months later, the ac- counting firm received the expected complaint and immediately forwarded it to the broker. The appeals court found that the broker had no direct authority to write insurance policies for the carrier. Rather, it went through an MGA. The court concluded that the broker was not an agent of the carrier.
