One of the most common questions I hear from clients is: "We have an employee with a medical marijuana card; what do we do?" Employers often are unsure about their rights and responsibilities when it comes to dealing with employees who hold the legal right to smoke marijuana in the state of Oregon. Many are concerned that such employees are immune from discipline, and have the legal right to smoke pot in the workplace without consequences. As of Jan. 1, there were 26,274 Oregon residents who were carrying valid medical marijuana cards issued by the state. Presently, 14 states, including Oregon, Wash...

The Bill of Rights is a tangible way to educate the public about their rights and to reinforce the responsibilities of agency and agency employees. Since I established the Bill of Rights for agencies under my purview, we have been contacted by other state and local government agencies wanting to follow suit. The Bill of Rights is enforceable by my administration and is also backed by our Constitution and Florida's strong open meeting and public record laws.

The family business faces a social responsibility dilemma in terms of displaced workers and limited job opportunities in the surrounding labor market if they purchase a new saw that would modernize production, improve profitability, and eliminate 50 percent of their labor costs. The most logical employment for these workers would be a cutter, loader, or hauler of logs, which have been determined to be some of the most dangerous jobs in the United States. This case requires students to examine the decision-making process of a modest family business in a small, cohesive community and the ramifications of these decisions, as well as issues concerning technology and production improvements, displaced worke...

The U.S. Fish and Wildlife Service (Service) proposes to establish a policy that covers Service procedures for accepting, using, and recognizing donations. This draft donations policy is an extension of the Department of the Interior's guidance on donations, found in the Departmental Manual (DM) at 374 DM 6. It focuses on the ethical considerations of all types of donations, as opposed to our Fish and Wildlife Service Manual (FW) guidance, 342 FW 5, Non-Purchase Acquisition, which covers the acquisition of real property rights by methods other than purchase, including donation. If finalized, this draft policy would establish procedures for reviewing and evaluating potential donors and donations. It lists delegations of authority for accepting donations and the roles and responsibilities...

The Treasury Department will administer the subsidy, providing employers or health plans, if they administer COBRA benefits, with a credit against payroll taxes for the cost of the subsidy, according to Donna Sasson, who heads up the medical benefits department at Petrone Associates in Princeton. A set of guidelines compiled by Sasson suggests employers: * Review records to identify all employees who became entitled to elect COBRA, including those who voluntarily resigned or were involuntarily terminated from employment, since September 1, 2008; * Update COBRA materials to comply with the new requirements; * Determine whether to permit individuals to elect a different health plan option when electing COBRA coverage; * Review severance policies to revisit the issue of any employer COBRA...
