The Employee Retirement Income Security Act (ERISA) of 1974, as amended, imposes significant responsibility upon retirement plan sponsors for the investments included in their plans. ERISA was enacted to curb abuses prevalent in retirement plans prior to its enactment. Under ERISA, a plan fiduciary can be held personally liable for losses experienced had the plan and any profits that the plan should have experienced had it been managed properly.
