In the case of Ellis-Don Construction v. HNTB Corp, the Court of Appeals of North Carolina reversed and remanded for further findings of fact and conclusions of law. It reviewed de novo whether the dispute was governed by the arbitration agreement. The court said that under the law then applicable the trial court shall proceed summarily to determine whether an agreement to arbitrate existed between the parties or risk committing reversible error. However, the trial court in this case did not do so. Thus, it reversed and remanded for further proceedings.
I am excited about the positive changes that could occur in Augusta in the next few years, but I am so tired of hearing people shoot down a forward-thinking idea because it's not business as usual. Historically, the way that Augusta has been conducting business has not gotten us very far. If you keep doing what you've always done, you're going to keep getting what you've always gotten. And Augusta hasn't gotten much from some of the commissioners who are now denouncing Andy Cheek's Ellis Street canal proposal.
