  • We are proposing to revise the Medicare hospital inpatient prospective payment systems (IPPS) for operating and capital-related costs of acute care hospitals to implement changes arising from our continuing experience with these systems. Some of the proposed changes implement certain statutory provisions contained in the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 (collectively known as the Affordable Care Act) and other legislation. These proposed changes would be applicable to discharges occurring on or after October 1, 2013, unless otherwise specified in this proposed rule. • The aim of this paper is to examine the impact of a set of firm-specific and policy related variables such as size, age, ownership and effective rate of assistance on the rate of production capacity realization (PCR) of firms. This study uses a panel of 92 food manufacturing firms of Bangladesh over the periods 1992-1994 and 1997-1999. Firm size is found to have positive impact while capital intensity and age of firm have negative impact on PCR at the firm level. The striking result is that the policy related variables such as the effective rate of assistance (ERA) and outward orientation (OPN) do not have any significant impact on PCR. These results are confirmed by the extensive test of sensitivity analysis. The insignificance of ERA and OPN may be attributed to piecemeal and partial ...

  • The Truth in Lending Act of 1968 (TILA) was a landmark piece of legislation that was designed to inform consumers about the true cost of credit. Prior to the TILA, lenders used many different methods to calculate the stated interest rate on a loan. The TILA required all lenders to state an annual percentage rate (APR) that was calculated on a consistent basis. This allowed consumers to compare rates, and to assess the cost of borrowing. Over the years, however, banks and other lenders sought and obtained numerous exceptions that allowed them to charge fees that were not included or disclosed in the APR. This practice has become so egregious that in a recent case, Pennsylvania Department of Banking v. NCAS of Delaware, a lender was able to legally claim an APR of 5.98%, while the actual ...

  • Scientific evidence demonstrates that the climate is changing at an increasingly rapid rate, outside the range to which society has adapted in the past. It is essential; therefore, that the EPA adapt to climate change in order to continue fulfilling its statutory, regulatory and programmatic requirements, chief among these protection of human health and the environment. Adaptation will involve anticipating and planning for changes in climate and incorporating considerations of climate change into many of the Agency's programs, pol...

  • Current digital-privacy regulation focuses predominantly on text records that contain personal data. Little attention has been paid to privacy in video files that may portray individuals in inappropriate contexts or in an unflattering or embarrassing light. As digital video technology, including inexpensive cell-phone cameras, becomes widespread in the hands ofthe public, the regulatory focus must shift. At one time a small percentage of online content, digital video is now appearing at an exponential rate. This is largely due to the growth of online social-networking platforms, such as YouTube and Facebook. Sharingvideo online has become a global phenomenon, while the lack of effective privacy protection for these images has become a global problem. Digital video poses four distinct pr...

  • Fifty-five thousand and counting: That's the number of complaints the Consumer Financial Protection Bureau (CFPB) had received as of June 30. In the CFPB's second "Semi-Annual Report to the President and Congress," Director Richard Cordray described the launch of the agency's Consumer Complaint Database as a means of bringing more transparency and efficiency to the marketplace. The report went on to state that the bureau has designed a first-rate infrastructure to receive, process and facilitate responses to consumer complaints. These practices are an integral part of an effective complaint process that meets regulators' expectations: 1. Formalize the complaint process, and make it easy for customers to register a complaint. 2. Involve and inform your board of directors. 3. Establish a ...
