The research literature has repeatedly demonstrated that there is an overrepresentation of juveniles with disabilities who are incarcerated in short-term and long-term correctional facilities. Despite these findings, special education programs in many juvenile correctional facilities have been shown to be lacking many of the necessary services mandated by federal law. The present article discusses the various legal challenges and difficulties faced by juvenile correctional education programs in providing special education services to incarcerated juveniles with disabilities, as well as the legislation and case law that currently exist to protect the right to special education services for all eligible juveniles. Ebeling comments on the continuing intrusion of political power into policy issues such as Social Security and public education. Many reform proposals threaten to entrench state power even more. Private investment accounts with Social Security dollars run the risk of politicizing the financial markets even more at the present. A voucher plan could extend further the government's rules and regulations to all private schools that accept these political dollars. Unless there are voices unafraid to present clearly and persuasively the principled and uncompromising case for a truly free society, the goal of liberty may never be established.
