Constructive receipt of rental income
Two 1995 Tax Court Memorandum decisions addressed the application of the constructive receipt doctrine and the tax treatment of funds placed in a trust to satisfy contested liabilities. In Hooper v. Commissioner, the tax Court found that the taxpayer was in constructive receipt of rental payments from a wholly owed corporation even though the taxpayer's board decided that no rental payments would be made. In Edison Brothers Stores, Inc. v. Commissioner, the court ruled that the taxpayer satisfied the requirements of IRC section 461(f) and could claim expense deductions for funds placed in an irrevocable trust to satisfy a potential liability with the government.
