  • The fallout from the Duke Lacrosse case hangs over this spring's Democratic primary for Durham district attorney, with each of the candidates-Freda Black, Tracey Cline, Mitch Garrell and Keith Bishop-ducking for cover. But Durham's next prosecutor will have to manage an office that handles about 70 non-headline-grabbing felony trials a year. Current District Attorney David Saacks, who was appointed by Gov. Mike Easley when Mike Nifong resigned over the lacrosse case, is not running for the post. There are two main things that come up with this. One is the cost. I don't think you can just raise it and leave it as things are right now because that's going to put an unbearable burden on the juvenile system. One estimate I heard is they would have to double their staff to handle this popula...

  • The families of former defendants Collin Finnerty, 20; Reade Seligmann, 21; and David Evans, 23; are expected to file civil suits against Durham District Attorney Mike Nifong, the Durham Police Dept., and the city and county of Durham, for what they believe were false and malicious prosecutions, based on false allegations of rape filed by a Black exotic dancer. Discovery evidence turned over to the defense last year failed to show any evidence that a rape, sexual assault or kidnapping occurred. Defense attorneys immediately began publicly branding the woman a "false accuser," further charging that D.A. Nifong was playing the race card, and thus, denying the defendants any possibility of a fair trial. In December, Duke Three defense attorneys exposed Nifong's "agreement" with the head of...

  • That's not how it was reported. Rather, it was reported that a Black stripper was accusing members of the Duke lacrosse team of rape after she and another woman were hired to dance for them at a party. That method of reportage put race and class in the center of the story. Predictably, the right wing media machine has kicked in, prompting mean-spirited attacks upon the accuser's character. Rush Limbaugh called the two women strippers "hos," and later apologized saying "I regret you heard me say that." And Michael savage referred to the alleged victim as a "Durham dirt-bag" and "dirty, verminous Black stripper." And, it is in this tense atmosphere that the accuser flees from home to home, fearing for her safety. The players got lawyers immediately, who advised them to talk to no one. Duk...
