One of the major premises of contemporary constitutional theory is the assumption that the Dred Scot decision was wrongly rendered, but that view may be too simplistic. The case held that no African American could be a citizen in the United States and that slavery could not be prohibited in what were then the American territories. Many argue that the decision points up the inadequacy of a constitution that would allow such a decision. Others conclude that those who would render evil decisions will arrive at such interpretations regardless of the contents or drafting of the constitution.
