Sometimes experienced traders can find themselves frustrated by unexpected legal realities. A recent case involved a particularly complicated instance of Warehouseman's Lien. The warehouseman was exercising 'Warehouseman's Lien', that is the right to recover unpaid charges for storage services by selling the goods held. Of course, the warehouseman must account to the owner of the goods for any excess received over the unpaid charges, but sale of the goods cannot be stopped except by payment of the outstanding debt. In this case, ownership of the goods was problematic. Cash against documents can only be used where the delivery chain is exclusively in the control of the seller; it specifies that no term of credit is available to the buyer.
