A lawyer who claimed that neck, back, shoulder and arm pain prevented her from performing repetitive tasks at her desk and computer was entitled to disability benefits under an ERISA plan, even though she was still able to dance and travel the world, a U.S. District Court in California has ruled.
The lawyer, a litigation associate, claimed long-term disability benefits, asserting that she was unable to perform repetitive motions at her desk and computer. After two years, the insurer denied further benefits, noting that she was able to go to salsa classes and travel internationally.

Private disability benefits paid to a wife during her marriage are her separate property, the California Court of Appeal has ruled.
Prior to her marriage, the wife had purchased a private disability policy, paid all the premiums and started collecting benefits. When the parties divorced, the wife sought reimbursement for the benefits payments made during the marriage, while the husband claimed that they were community property.

A divorced man could be required to pay his former wife a share of his veterans' disability benefits if the parties' property settlement agreement granted her a share of his military retirement pay, the California Court of Appeal has ruled.
The husband was a colonel in the U.S. Army at the time the parties divorced. Their property settlement agreement awarded the wife approximately 30 percent of the husband's military retirement.

Chief's disease" is a nickname given to the widespread practice among top California Highway Patrol officials of inflating their retirement benefits with dubious medical disability claims.

According to Rev. Rul. 2004-55, when a plan providing long-term disability benefits is amended, the amended plan is a new plan in computing the employer's and employee's contributions. The amended plan is not a contributory plan and, accordingly, there is no need to determine the portion of amounts received that is attributable to employer contributions. Under the amended plan, long-term disability benefits received by an employee whose coverage is paid by the employer on a pre-tax basis for the plan year, in which the employee becomes disabled, are attributable solely to pre-tax employer contributions. Thus, they are includible in the employee's gross income under Section 105(a).
