In the Department of Homeland Security's latest attempt to expedite the release of its blocked "no-match" regulation, the US Department of Justice filed a notice of appeal on the agency's behalf seeking to overturn the Oct 10, 2007, preliminary injunction granted by Judge Charles Breyer of the Northern District of California stopping DHS from implementing its "no-match" regulation, including mailing or otherwise sending to employers Social Security Administration "no-match" letter packets that have DHS guidance letters explaining the regulation. During peak harvest season, Jack Vessey hires some 500 workers to pick lettuce, broccoli and other row crops on his farm in California's Imperial Valley, smack up against the Mexican border. Much of his labor originates in Mexico. Yet, not a single worker lacks the necessary immigration papers required to work in the US. During harvest, Vessey needs about 500 more temporary workers, whom he typically pays about $7.50 to $8 per hour. Most of them he gets from farm labor contractors, who simply park their buses near the border and load up with workers who can show documents. The lawsuit alleged that John Jay College engaged in a pattern or practice of citizenship status discrimination by requesting documents issued by the Department of Homeland Security (DHS) from non-U.S. citizens, but not from U.S. citizens, during the employment eligibility verification Form I-9 process.
