Despite the widespread notion that defined-benefit plans are more expensive for employers to manage than defined-contribution plans, a new report finds that might not be the case. In fact, defined-benefit plans can deliver the same benefit at half the cost of defined-contribution plans, according to "A Better Bang for the Buck," which was published in August by the National Institute on Retirement Security. One of the primary reasons for the differential is that defined-benefit plans achieve higher investment returns than defined-contribution plans, the report says. Defined-benefit plans can maintain a well-diversified portfolio over time.

Defined-contribution participants aren't the only ones asking whether they will have enough money for retirement, one consulting group has found. Mercer reported a 40% increase in defined-benefit participants asking for their estimated end benefit in 2009 versus 2008, says Andrew Yerre, defined-benefit business leader in the company's US outsourcing division. A new annual funding notice is probably another cause for the bump in requests, Yerre says. This notice simplifies the financial information found in the report, highlighting the funded status or health of the plan as well as its liabilities.

Both Chrysler and GM used asset sales under section 363 of the Bankruptcy Code as a way to avoid the more cumbersome chapter 11 plan process. The strategic use of section 363 asset sales in reorganization cases is becoming so common that some courts and commentators predict that the asset-sale route to a chapter 11 plan confirmation may soon supplant the traditional chapter 11 plan process. While some have decried section 363 sales as contrary to the voting system and other procedural safeguards inherent in a standard chapter 11 confirmation, this Essay argues that the section 363 asset-sale development is a natural consequence of the Bankruptcy Code being weighed down by a “springing” (or bankruptcy-only) priority of retiree medical benefits. Not only are springing prioriti...

Reform" is one of those words that politics has rendered meaningless.
As retired Trib business editor and current columnist Jack Markowitz reminded me the other day, there's tragically little "reform" in such catch-proposals as "Social Security reform," "health-care reform," "immigration reform" and "earmarks reform." Anytime a politician touts reform, you can bet it isn't.
