Wausau entered into two reinsurance contracts with Century that covered different layers of one of Century's policies. After Century paid out on the underlying insurance policy, it sought coverage under its reinsurance contracts, including the two it entered into with Wausau. Century demanded that Wausau and its other reinsurers participate in a consolidated arbitration. Wausau filed a declaratory judgment action in federal district court, seeking to establish that it was entitled to two separate arbitrations. The 7th Circuit rejected Wausau's argument that consolidation is an arbitrability issue.

Wells Fargo & Co. asked a federal judge Tuesday to rule that a letter agreement between Wachovia Corp. and Citigroup Inc. is invalid and that it wouldn't be liable for damages in a lawsuit over its acquisition of Wachovia.
Wells Fargo, which agreed to buy Wachovia after topping a Citigroup bid earlier this month, filed a request for a declaratory judgment in Manhattan federal court as part of a new lawsuit against Citigroup. Wells Fargo, based in San Francisco, said it is concerned that Citigroup might sue it for interfering with an aborted Wachovia- Citigroup merger.

An insurance company is seeking a pre-emptive strike against a bad faith claim stemming from a $6 million wrongful death judgment in Johnson County last month.
American Standard Insurance Co. of Wisconsin claims it is being "set up" for a bad faith claim from Jeffrey Alewine. The company filed a request for declaratory judgment and an injunction in federal court in Kansas City Wednesday, although Alewine has yet to file suit.

Currently, these options trade exclusively on the Chicago Board Options Exchange pursuant to licensing arrangements between the CBOE and the two index providers: Dow Jones and the McGraw-Hill Companies (owner of Standard & Poor's).
