AUGUSTA Maine Attorney General William J. Schneider has ruled that a Maine State Police detectives use of deadly force against a Skowhegan man last year was justified.
Schneider found that Kemp Lybrook, who was 29 at the time of the Oct. 4, 2010, incident, posed an imminent lethal threat to Detective Mark Sperrey and other officers as he approached them with two firearms after an hours-long standoff.

BEIRUT -- Syrian security forces and pro-government gunmen killed four protesters yesterday in the port city of Banias after the army sealed off the city as hundreds of protesters gathered, undaunted by the regime's use of deadly force to quell more than three weeks of unrest, witnesses said. State TV reported that nine soldiers were killed in an ambush near the city.
Details were sketchy because telephone lines, Internet access and electricity apparently were cut to most parts of the city. Army tanks and soldiers circled the city, preventing people from entering.

Deadly private violence is an unfortunate fact of life in New York. Obviously, no one wishes to be the target of such violence. Should the situation arise, however, a New Yorker must retreat if practicable before responding with defensive deadly force. This rule has an important exception: An innocent person under siege inside her own home is legally justified in killing her attacker without backing down. Although states commonly exempt those assaulted in their dwellings from retreat, the exception varies in its application. This article examines the duty to retreat before using defensive deadly force. It argues that retreat follows from the necessity requirement built into the concept of justification. The Justice Department has opened a civil investigation into accusations of excessive use of deadly force by members of the Miami Police Department (MPD) in the wake of the killing by police of eight black men over the past 16 months.
Assistant Attorney General Thomas E. Perez, who heads the department's Civil Rights Division, said Thursday in Miami the non- criminal inquiry will determine whether Miami police violated the civil rights of the men as part of a "pattern or practice" within the Miami Police Department that led to constitutional violations.
