HARRISON TWP., Montgomery County -- Danis Building Construction Company has filed a lawsuit against Northridge Local School District, demanding $118,000 in actual damages.
The lawsuit, filed May 7, also asks for $450,000 in attorney fees and punitive damages against the district.

The trial court erred in finding that an insurer had a duty to advance costs, despite a policy provision that excluded coverage for pollution-related claims. The underlying litigation challenged a corporate reorganization that was allegedly intended to let the insureds evade liability for pollution settlements. These alleged wrongful acts were intertwined with the pollution settlements and were not intervening acts that broke the causal connection. Consequently, the pollution exclusion applied, and the insurer did not have a duty to advance litigation costs. Judgment reversed and remanded.
